Trump Asks Supreme Court Approval for Military Reserve Personnel in the State of Illinois
On Friday, the White House petitioned urgently to the US supreme court, requesting clearance to deploy state guard forces to Illinois.
This move is part of a wider campaign to expand the domestic use of the troops in multiple urban centers under Democratic control.
Legal Battle Over Troop Deployment
In an immediate request, the justice department urged the bench to reverse a earlier court order that had blocked the deployment of several hundred state guard members to the greater Chicago.
The federal judge had voiced concerns about the administration's reasoning for sending troops, challenging its reasoning in light of local conditions.
A higher court supported the lower court’s decision on Thursday, keeping the stationing on hold while the judicial dispute continues.
Government's Claims
The top government lawyer, acting for the White House, stated in the new filing that government officers have often been “menaced and targeted” in Chicago and the suburb of Broadview.
This location is home to an federal immigration holding center.
The former president has already dispatched military reserve units to the Windy City and the city of Portland, following earlier activations to Los Angeles, the city of Memphis, and the nation's capital.
The White House has argued that military intervention is necessary to curb unrest and strengthen immigration enforcement.
Partisan Resistance
Elected Democrats have strongly opposed the decision, saying that the president’s claims are inflated and partisan in nature.
They allege the administration of abusing his authority to punish opponents.
The judiciary have also expressed doubt about the White House's description of events.
Local leaders state that demonstrations over ICE activities have been largely modest and peaceful, contrasting with the administration's characterization of “combat area” situations.
Statutory Grounds
At the center of the legal battle is the president’s use of a federal statute allowing the executive branch to nationalize the military reserve only in situations of insurrection or when “powerless with the regular forces to carry out the statutes of the nation”.
The White House insists that the forces are required to safeguard federal property and personnel from demonstrators.
Latest Developments
Earlier this month, the government federalized several hundred members of the state guard of Illinois and commanded more Texas national guard forces into the Illinois.
As local leaders condemned the action, the White House escalated his rhetoric, urging the detention of the mayor of Chicago and the state's chief executive, both Democrats, charging them of neglecting to secure federal agents.
Illinois and the city of Chicago jointly sued the administration to stop the activation.
On October 9, the presiding federal judge, a Biden appointee, delivered a temporary injunction blocking the command.
Local Events
Simultaneously in Chicago, at least eleven people were detained outside the ICE facility in Broadview following intense clashes between Illinois state police and activists.
